১৯৭৫ সালের ১৫ আগস্ট কতিপয় উগ্রবাদী সেনা সদস্য জাতির জনক বঙ্গবন্ধু শেখ মুজিবুর রহমানকে স্বপরিবারে হত্যা করে।হত্যাকারিরা ক্ষমতাসীন হয়ে ওই বছর ২৬ সেপ্টেম্বর ‘ ইনডেমনিটি ‘ অডিন্যান্স জারি করে। যা পরবর্তী প্রেসিডেন্ট জিয়াউর রহমান ১৯৭৯ সালে সেটিকে আইনে পরিণত করেন। হত্যাকাণ্ডের ২১ বছর পর ১৯৯৬ সালে ক্ষমতাসীন হয় আওয়ামী লীগ।
বাতিল করে ‘ইনডেমনিটি অ্যাক্ট’। এরপর ধানমন্ডি থানায় মামলা দায়ের করা হয়। ১৯৯৮ সালের ৮ নভেম্বর ঢাকা জেলা দায়রা জজ আদালত ১৮ আসামির মধ্যে ১৫ জনকে মৃত্যুদণ্ডের আদেশ দেন। আসামিরা আপিল করেন। ২০০০ সালের ১৪ ডিসেম্বর হাইকোর্টে বিভক্ত রায় প্রকাশ হয়। পরে ১২ জনের মৃত্যুদণ্ডাদেশ বহাল থাকে।
কীভাবে বঙ্গবন্ধুকে স্বপরিবারে হত্যা মামলার বিচার হয়েছিল তা নতুন প্রজন্মের অনেকের কাছে অজানা! বাংলাদেশ নিউজ এজেন্সি(বিএনএ) বঙ্গবন্ধু হত্যা মামলার পূর্ণাঙ্গ রায় ধারাবাহিকভাবে প্রকাশ করছে।

১। আসামী লে. কর্নেল সৈয়দ ফারুক রহমানের লিখিত বিবৃতি :
I cannot read and write Bengali and the fact is contained in my service book. My service book has been withheld from this court. I was educated although in the then West Pakistan and had no opportunity to learn how to read and write Bengali. I was arrested on 13.8.96 without any case against me. I was produce in court for the first time of 19.12.96 (the day of executing confession and last day of police confinement). I was in police confinement without any remand order from any court. My detention as a detenu expired on 11.12.96. but I was taken out from Jail custody to police custody on 12.12.96 by order of the Ministry of Home and not by order of any Court. I was kept in police custody for a total of 32 days. A joint interrogation cell composed of SB, NSI, CID and other elements interrogated me by complying third degree methods. They prepared as statement themselves and forced me to sign it as my statement under Section 161 Cr. P.C.A few of the interrogation cell cautioned others reminding that no signature for such a statement is any necessary requirement of law. I was escorted to a place by CID police ( in plain cloth) as well as by police in uniform where the cell people brought out their said prepared statement for line by line recording by the Magistrate in his open court in presence of also court police and I was forced by the police to sign it. This happened on 19.12.96 without any consolation as to where I was to be sent thereafter.
I retracted my statement claimed by prosecution to be a confessional statement at the first oppurtunity . Five sheets of paper are attached to the printed form of my statement (Exhibit-3). Out of those papers nine pages are not signed and sealed by the Magistrate. That document shows itself that there are material commission in filling up the paragraphs of the printed form. The document also shows itself that the Bengali script said to be my confessional statement was not read over to me. The fact is evedent from the document itself.
It is from the mouth of the Investigating Officer of the case that he was supplied the copy of proceedings held by the court of inquiry in the matter of killing of soldier Shamsul Haque and injury of soldier Mofazzal claimed to have been caused in the incident under trial by this case. He also added that he got unsigned copy of the post-mortem report on the deadbody of the soldier Shamsul Haque. If the copy of the proceedings and that of the post-mortem report would have been produced in the court, a different case as to time, place and manner of the incident involving peole excluding myself would have come to light. It is for that reason , the prosecution withheld the proceedings of the court of inquiry and the post-mortem report as aforesaid.–চলবে
